Agreement

These Terms of Use ("Terms") govern your access to and use of the NextPark mobile application and website at www.nextparkapp.com (together, the "Service"), operated by NextPark ("NextPark," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You are responsible for ensuring your use complies with applicable laws in your location.

Features involving payments — including hosting or joining paid exclusive runs and receiving payouts — require you to be at least 18 years old and may require identity verification through our payment provider.

NextPark is built for pickup basketball communities. The Service currently focuses on New York City courts and related features; availability may change over time.

Your account

  • You are responsible for activity that occurs under your account.
  • You agree to provide accurate information and keep your account credentials secure.
  • You may not impersonate others, create accounts for abusive purposes, or share access in ways that violate these Terms.
  • We may suspend or terminate accounts that violate these Terms or create risk for other users or the Service.

Acceptable use

You agree not to:

  • Harass, threaten, defame, or discriminate against other users
  • Post unlawful, fraudulent, hateful, sexually explicit, or otherwise objectionable content
  • Upload content you do not have the right to share, including others' private information without consent
  • Spam, scrape, reverse engineer, or attempt to disrupt the Service or its infrastructure
  • Circumvent security, payment, or access controls
  • Use the Service for unauthorized commercial solicitation or gambling where prohibited
  • Misrepresent your identity, skill level, or affiliation in ways that harm others

We provide reporting tools in the app. We may remove content, restrict features, or suspend accounts at our discretion to protect the community.

User content

You retain ownership of content you submit ("User Content"), including messages, posts, photos, and profile information. By submitting User Content, you grant NextPark a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and improve the Service.

You represent that you have the rights needed to submit User Content and that it does not violate these Terms or third-party rights. We are not obligated to monitor all User Content but may do so.

Organized runs, queues, and in-person activity

NextPark helps players coordinate pickup games, call-next queues, ETAs, park chats, and hosted runs. NextPark does not operate courts, employ hosts, or guarantee that any game will occur, be safe, or meet your expectations.

You are solely responsible for your decisions to travel to, participate in, or host any in-person activity. Basketball involves inherent physical risk. Use good judgment, respect venue rules, and follow applicable laws.

Exclusive runs and payments

Some features allow users to list, join, or host paid or unpaid exclusive runs. Paid transactions are processed by Stripe. By participating, you also agree to Stripe's applicable terms and privacy practices.

  • Hosts. If you host paid runs, you may need to complete Stripe Connect onboarding. You are responsible for accurate listing details, attendance expectations, and compliance with tax and payout obligations applicable to you.
  • Participants. You authorize charges shown at checkout for the run you join. Refund and cancellation outcomes depend on the run status, host actions, and product rules displayed in the app at the time of purchase.
  • No escrow guarantee. NextPark facilitates coordination and payment processing but is not a party to your agreement with other players except as stated in these Terms.

Payment disputes should first be directed to support@nextparkapp.com. Chargebacks or abuse of payment systems may result in account restrictions.

Third-party services and links

The Service integrates with third-party services (including InstantDB, Stripe, and push notification providers). We are not responsible for third-party websites, services, or policies. Your use of those services may be subject to their separate terms.

Intellectual property

NextPark and its logos, design, and software are owned by NextPark or its licensors and are protected by intellectual property laws. Except for the limited rights needed to use the Service, no license is granted to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTPARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that court information, activity estimates, or user-generated content will be accurate or complete.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTPARK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE OR ANY IN-PERSON ACTIVITY ORGANIZED THROUGH IT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTPARK'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID NEXTPARK IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.

Indemnification

You agree to indemnify and hold harmless NextPark from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your in-person activities, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where prohibited by the laws of your jurisdiction. You agree that courts located in New York County, New York will have exclusive jurisdiction over disputes arising from these Terms or the Service, unless applicable law requires otherwise.
